Please read these Terms and Conditions ("Terms") carefully before using the Trick or Treat website located at www.trickortreatmap.com ("Website"). By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Website.


These Terms form a legal agreement between you ("you", "your", or "User") and Community Maps Limited ("we", "us", "our"), a company registered in Guernsey, Channel Islands. Trick or Treat is a trading name of Community Maps Limited, a company registered in Guernsey, Channel Islands.



1. Definitions


• "User" means any person who accesses or uses the Website.


• "Stop" means a user-submitted location on the map offering Halloween treats or activities.


• "Upgrade" refers to paid features offered through Glow and Spotlight packages.


• "Content" includes any data, text, images, video, audio, or materials submitted or displayed by a User.


• "Website" refers to www.trickortreatmap.com and all associated services provided by Community Maps Limited.


• "Paid User" means a user who has purchased an upgrade package.



2. Eligibility and Account Registration


2.1 You must be at least 18 years of age to create an account or use any interactive features of the Website.


2.2 While account creation requires users to be 18 or over, we recognize that families with children use our service. Parents and guardians are solely responsible for supervising their children's participation in trick-or-treating activities and for ensuring their safety when visiting stops listed on our platform.


2.3 You agree to provide accurate, complete, and current information during registration and to update such information to keep it accurate.


2.4 You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.


2.5 We may suspend or terminate your access if we believe you are misusing the Website or have violated these Terms.





3. Use of the Website


3.1 The Website is provided to help communities plan Halloween activities.


3.2 You agree not to:


• Exploit or misuse the Website or map for commercial, political, or non-Halloween-related purposes without prior consent;

• Post personal information of other individuals without their consent;

• Use automated tools, bots, or scripts to access or interact with the Website, including mass submissions or vote manipulation;

• Upload or link to malicious code, viruses, phishing content, or harmful software;

• Use the Website in a way that could damage our reputation or undermine trust in the platform;

• Use the Website for unlawful or fraudulent purposes;

• Post or share misleading, harmful, or offensive Content;

• Attempt to gain unauthorized access to the Website;

• Scrape, copy, or republish any part of the Website without permission;

• Interfere with or disrupt the Website or its infrastructure.


3.3 You must only add Stop's for addresses where you have permission to do so. Adding a Stop to someone else's property without consent may lead to suspension or removal.


3.4 The Website operates year-round, with peak functionality and support provided during the Halloween season (September 5 - November 5). Outside this period, some features may have limited availability or support response times may be longer.



4. User Content and Conduct


4.1 Users may submit Content, including Stop details, and messages. You retain ownership of your Content but grant us a non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, publish, and distribute it in connection with the Website.


4.2 We do not endorse or guarantee the accuracy, legality or appropriateness of any Content submitted by Users. Use caution and common sense when interacting with others via the Website.


4.3 We reserve the right to remove or moderate any Content or accounts that we believe breach these Terms, the law, or community standards.


4.4 We also reserve the right to suspend or permanently remove any user account, including Paid Users, at our sole discretion if we believe a user has breached the conduct standards outlined in section 3 or otherwise used the Website in a manner that we consider harmful, disruptive, or contrary to the intended use of the platform. No refund will be issued in such cases


4.5 Stops submitted by users will remain live and visible on the map year-round unless actively deleted by the user. We will send annual reminders prior to each Halloween season to users with existing stops, allowing them to review, update, or remove their stops as needed. Users can delete their stops at any time.




5. Upgrades, Payments, and Refunds


5.1 Basic use of the Website is free. Optional paid upgrades provide enhanced features and visibility.


5.2 All payments are securely processed through our third-party payment processor (Stripe). You agree to their terms of service.


5.3 Upgrades are a one-time purchase and remain active until 11:59 PM on 5 November of the calendar year following the purchase date. For example, an upgrade purchased in October 2025 will expire on 5 November 2025. An upgrade purchased on 6 November 2025 will expire on 5 November 2026.


5.4 Paid Users will automatically revert to free user status at the end of the upgrade period.


5.5 All payments are final and non-refundable unless required by law.


5.6 We reserve the right to modify or discontinue features of any upgrade at our discretion without liability.




6. Competitions


6.1 Competitions are open to registered users aged 18 or over and are governed by separate Competition Terms.


6.2 Users may vote on entries and enter competitions as permitted by their upgrade tier.




7. Termination and Suspension


7.1 We may suspend, restrict, or terminate access to your account and/or the Website at our sole discretion if we believe you have violated these Terms or used the Website inappropriately.


7.2 If your account is terminated, you may lose access to your Stop, Content, and any competition data.




8. Data Protection and Privacy


8.1 Your personal data may be transferred to and stored outside the United Kingdom or European Economic Area (EEA), including in countries such as the United States. Where we do so, we take appropriate measures to ensure your data is protected in line with applicable laws.


8.2 Your personal data is handled in accordance with our Privacy Policy, available at www.trickortreatmap.com/privacy-policy.


8.3 By using the Website, you consent to the collection and use of your data as outlined in that policy. We process your data based on consent, performance of a contract, and our legitimate interests, as further detailed in our Privacy Policy.




9. Intellectual Property


9.1 All intellectual property rights in the Website, content, logos, and software are owned or licensed by us. You may not reproduce or use them without permission.


9.2 You may not use the Trick or Treat name, logo, or brand in a way that implies partnership or endorsement unless expressly authorised.



10. Disclaimers and Limitations of Liability


10.1 The Website is provided "as is" without warranties of any kind.


10.2 We do not guarantee that all Stops are accurate, safe, or active. You participate in Halloween activities at your own risk.


10.3 While we strive to ensure the Website is secure and functional, we do not warrant that it will be error-free, uninterrupted, or free from viruses or other harmful components. This includes, but is not limited to, outages caused by server failures, software bugs, system maintenance, high traffic, denial-of-service attacks, or other disruptions beyond our reasonable control.


10.3.1 In the event of any such disruption or technical fault that limits access to the Website or affects your use of upgrade features, you acknowledge and agree that no refunds or extensions will be provided. Your use of paid features remains subject to the standard upgrade period regardless of any temporary interruption in service.


10.4 To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential losses arising from use of the Website.


10.5 Our total liability to you for any claim will not exceed the amount paid by you to us in the past 12 months (if any).


10.6 Nothing in these Terms shall limit or exclude our liability for death or personal injury resulting from our negligence, fraud, or any liability that cannot be limited by law.




11. Dispute Resolution


11.1 We encourage you to contact us first at support@trickortreatmap.com to try to resolve any complaints or disputes informally.


11.2 If a dispute cannot be resolved amicably, you agree to attempt to resolve the issue through mediation before resorting to formal legal proceedings.


11.3 Any legal proceedings arising out of or relating to these Terms shall be brought exclusively in the courts of England and Wales.




12. Reporting and Complaints


12.1 We may, at our discretion, review flagged content or accounts, but we are not obligated to provide individual feedback or justification. All moderation and removal decisions made by Trick or Treat are final.


12.2 If you believe a Stop or user account has been added without permission, includes inappropriate content, or poses a safety risk, you should report the issue via the "Flag" feature on the Website or by emailing support@trickortreatmap.com.


12.3 We take abuse reports seriously and reserve the right to investigate, moderate, or remove content or accounts as necessary.


12.4 Abuse of the reporting system may itself result in suspension or restriction of your account.


12.5 We use a combination of automated and manual review processes to assess reports. If a Stop receives a certain number of flags, it may be automatically hidden from the default map view.


12.6 Users must only flag Stops in good faith. Deliberately false or retaliatory flagging undermines the integrity of the platform and may lead to disciplinary action including suspension or removal from the Website.




13. Third-Party Services


13.1 The Website integrates services provided by third parties such as Mapbox (maps), Stripe (payments), and others. We are not responsible for their content, policies, or services.


13.2 Links to third-party websites do not constitute endorsement.




14. Changes to These Terms


14.1 We may modify these Terms at any time. Material changes will be communicated via the Website or email.


14.2 Your continued use of the Website after changes have been made constitutes acceptance of those changes.




15. Governing Law and Jurisdiction


15.1 These Terms are governed by the laws of England and Wales. Although Community Maps Limited is incorporated in Guernsey, Channel Islands, we have chosen English law to govern these Terms to provide greater legal certainty and familiarity for our users.


15.2 You agree that the courts of England and Wales have exclusive jurisdiction to settle any disputes.
